Veintitseis estados tienen leyes relacionadas a las oportunidades de negocio. La mayoría de estas leyes prohíbe la venta de oportunidades de negocio a menos que el vendedor le entregue al potencial comprador un documento pre-venta en el cual se establezca la información sobre la oportunidad de negocio, la cual debe registrarse previamente en la agencia estatal designada.
Generalmente, las leyes relacionadas a las oportunidades de negocio abarcan todas las oportunidades de negocio que pueden ser ofrecidas. En caso de que un vendedor de oportunidades de negocio no se encontrara obligado a proporcionar el documento informativo bajo lo establecido por la Regla de Franquicias y Negocios (Franchise and Business Rule) de la FTC, estas declaraciones informativas casi siempre sí son requeridas por las leyes de los estados que se listan más abajo.
Los datos informativos requeridos por las leyes estatales de oportunidades de negocio difieren y generalmente disponen información más abreviada de la que estipula la Regla de Franquicias y Negocios de la FTC. Sin embargo, la mayoría de estas leyes otorga derechos y medidas compensatorias importantes para los inversores de oportunidades de negocios, incluyendo el requisito de disponer de valores en garantía (seccurity bonds) para cubrir las pérdidas de los inversionistas.
